FAQ

Common questions about real estate law

Answers to the questions we hear most often.

Do I need an attorney to buy or sell property in Georgia?

Georgia does not require an attorney for real estate transactions, but having one is strongly advisable. An attorney reviews contracts for unfavorable terms, identifies title defects, and protects your legal rights in ways a real estate agent cannot.

What is an easement and how does it affect my property?

An easement grants another party the right to use a portion of your property for a specific purpose. Easements are tied to the land, not the owner, and must be disclosed in any sale.

How does Georgia handle landlord-tenant disputes?

Georgia's landlord-tenant law is governed by O.C.G.A. Title 44, Chapter 7. Compared to many states, Georgia law is relatively landlord-friendly, but landlords must follow strict procedures. We represent both landlords and tenants.

What happens if the other party backs out of a purchase agreement?

Your remedies depend on the contract terms and which party breached. Options include retaining the earnest money deposit, suing for specific performance, or seeking damages. We'll review your agreement and advise on the strongest path forward.
