FAQ
Common questions about appellate law
Answers to the questions we hear most often.
Can I appeal any court decision?
Generally, you can appeal a final judgment from a trial court. The appellate court does not retry the facts — it reviews whether the trial court made legal errors. We'll assess whether you have viable grounds before advising you to proceed.
How long does a Georgia appeal take?
A typical Georgia Court of Appeals case takes 18 months to three years from notice of appeal to decision. Eleventh Circuit federal appeals take roughly 18 to 24 months on average. Writ petitions can move much faster.
Does filing an appeal stop enforcement of the judgment?
Not automatically. To stay enforcement of a money judgment pending appeal, you typically need to post a bond or obtain a court order. We can advise on the best approach to protect your position while the appeal is pending.
Can I introduce new evidence on appeal?
No. Appellate courts are limited to the record established in the trial court. This is why involving appellate counsel early — even during trial — is so valuable.
