Dispossessory Proceedings (Evictions)

Georgia's dispossessory process begins with a demand for possession followed by filing in the Magistrate Court of the county where the property is located — Hall County Magistrate Court in Gainesville, Gwinnett County Magistrate Court in Lawrenceville, and so on. Notice Requirements

Georgia law requires specific written notice before filing a dispossessory — generally a demand for possession that allows the tenant a brief period to vacate voluntarily. Security Deposit Disputes

Georgia's security deposit statute (O.C.G.A. § 44-7-30 et seq.) requires landlords to return the deposit (less properly documented deductions) within 30 days of the end of the tenancy and return of possession. Failure to comply can result in forfeiture of the right to the deposit plus a penalty equal to three times the wrongfully withheld amount.
